By accessing or using the RightPaw platform, you agree to be bound by these Terms of Use, our Privacy Policy, the RightPaw Code of Ethics, and any other policies referenced on the platform.

The RightPaw Code of Ethics is incorporated by reference into these Terms and forms part of these Terms where applicable, including in relation to breeders participating on the platform.

If you do not agree to these terms, please do not use the platform.

RightPaw provides an online platform that connects prospective pet owners with breeders.

RightPaw does not:

• Breed animals
• Sell animals
• Take ownership of animals
• Handle deposits or payments
• Act as an agent for buyers or breeders
• Facilitate ownership transfers

All transactions and agreements are entered into directly between breeders and prospective pet owners.

Breeders who apply to join RightPaw may undergo a review process that can include the assessment of:

• Profile information
• Registration details
• Health testing information
• Veterinary records
• Supporting documentation
• Breeding practices

Breeders participating on RightPaw agree to the RightPaw Code of Ethics.

Participation on RightPaw should not be interpreted as accreditation, certification, endorsement, or a guarantee of future conduct, legal compliance, breeding outcomes, or animal health.

Prospective pet owners are responsible for:

• Providing accurate information when submitting enquiries.
• Conducting their own due diligence before acquiring a pet.
• Reviewing breeder information carefully.
• Asking questions relevant to their decision.
• Assessing whether a pet is suitable for their lifestyle and circumstances.

Breeders are responsible for:

• Ensuring information provided on the platform is accurate and up to date.
• Ensuring that any statements or claims about animal health, veterinary checks, health testing, pedigree, temperament, breeding history, availability, or suitability are accurate, complete, and not misleading.
• Complying with applicable laws including the Animals Protection Act 71 of 1962, regulations, by-laws, and consumer protection requirements.
• Maintaining appropriate standards of animal welfare and complying with all applicable animal welfare, municipal, provincial, and national requirements.
• Promptly updating or correcting any breeder profile, listing, or information that is inaccurate, incomplete, outdated, or misleading.
• Conducting transactions directly with prospective pet owners.
• Complying with the RightPaw Code of Ethics.

Breeders may only use buyer information for the purpose of responding to enquiries received through the platform and must handle such information confidentially, securely, and in accordance with applicable data protection laws.

The sale, sharing, transfer, or unrelated marketing use of buyer information is prohibited.

By submitting an enquiry through RightPaw, users acknowledge that their personal information will be processed in accordance with the Privacy Policy and applicable data protection laws, including the Protection of Personal Information Act, 2013, for the purpose of receiving, managing, and responding to their enquiry.

Where applicable, user information may be shared only to the extent reasonably necessary for the following purposes:

• With relevant breeders, to enable them to respond to the user's enquiry.
• With service providers assisting with the operation, hosting, maintenance, administration, security, or support of the platform.
• With dotsure.co.za only where this is disclosed in the Privacy Policy and permitted under applicable law, including where the user has given any consent required for separate insurance-related, commercial, or marketing communications.

RightPaw will not use or share user information for unrelated purposes unless the user has been informed of such purpose and the processing is permitted by applicable law.

RightPaw does not guarantee:

• Animal health
• Animal temperament
• Breeding outcomes
• Future breeder conduct
• Legal compliance by breeders
• Availability of animals
• Suitability of animals for individual buyers

Information made available through the platform is provided for informational purposes only.

All discussions, agreements, deposits, payments, refunds, warranties, guarantees, and transactions occur directly between breeders and prospective pet owners.

RightPaw is not a party to these arrangements and accepts no responsibility for disputes arising from them.

RightPaw reserves the right to:

• Request additional information from breeders.
• Conduct additional reviews.
• Suspend or remove listings.
• Restrict access to the platform.
• Remove breeder profiles.

These actions may be taken where participation appears inconsistent with:

• Platform policies
• The RightPaw Code of Ethics
• Animal welfare considerations
• Applicable laws

All content, branding, logos, designs, text, and platform materials remain the property of RightPaw or its licensors unless otherwise stated.

Users may not copy, reproduce, distribute, or commercially exploit platform content without prior written consent.

To the fullest extent permitted by law, RightPaw shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from:

• Use of the platform
• Breeder conduct
• Animal health issues
• Transactions between buyers and breeders
• Reliance on information provided through the platform

Users access and use the platform at their own risk.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

RightPaw may update these Terms of Use from time to time.

Updated versions will be published on the platform and become effective upon publication.

Users and breeders may not use the platform for any unlawful, misleading, abusive, fraudulent, automated, or harmful purpose, including impersonation, scraping platform data, interfering with platform security or operation, or misusing breeder, buyer, or personal information.

Users and breeders indemnify RightPaw and its related parties against any claims, losses, costs, or liabilities arising from their breach of these Terms, unlawful conduct, inaccurate or misleading information, misuse of the platform or personal information, third-party rights infringement, or any buyer-breeder dispute or transaction.

These Terms of Use are governed by the laws of the Republic of South Africa.

Any disputes arising from the use of the platform shall be subject to the jurisdiction of South African courts.
